Traffic & Parking

The Miami-Dade County Courthouse handles cases pertaining to civil traffic infractions, criminal traffic violations, parking citations, and boating and wildlife citations.

Civil, Family Court & Marriage

The civil, family and marriage services are broken down into the following types: civil court, small claims, restraining orders, juvenile court, probate court, simplified divorces, family court, central depository child support and alimony, domestic violence, marriage licenses, mental health court, judgments, and an appellate division.

County court cases are governed by the rules of civil procedure. These rules cover cases where the amount of damages exceeds $8,000 but is not more than $50,000 as well as tenant eviction cases.

Small Claims cases are where the amount of money does not exceed $8,000 exclusive of interest, court costs and attorney fees.

Circuit court handles cases such as:

  • Cases where the amount of money exceeds $50,001, exclusive of interest, court costs and attorney fees
  • Eviction cases where damages claimed exceed $50,001
  • Actions of ejectment
  • Actions involving the title and boundaries of real property
  • Issuance of injunctions -such as: Replevin, Negligence, Professional Malpractice, Products Liability, Mortgage Foreclosures, Eminent Domain, Bond Estreatures, Writs, and Foreign Judgments

Criminal Court

The Miami-Dade Criminal Courthouse is comprised of two levels of operations: Circuit Criminal and County Criminal.

The Miami-Dade Clerk of the Courts handles several topics regarding home and property issues such as: declaration of domicile, deed fraud, landlord and tenant disputes, code enforcement, property tax deeds, mortgage foreclosures, and value adjustment.
